Chapter 1. Basics of Country House Construction. Building permit for a house in 2026: what you need to know.

Since 2019 a building permit for a private house has been replaced by a notification procedure. It sounds simple, but there are many nuances that can lead to refusal, fines, or even demolition.

Which houses qualify for the notification procedure

• Up to 3 above-ground floors (attic counts)

• Height ≤ 20 m

• Not divisible into separate apartments

• No area limit, but houses above 500 m² need design expertise

4 steps of the procedure

Step 1. Notification of planned construction

Submitted to the municipal administration (in person, MFC, Gosuslugi). Include developer details, cadastral number, permitted use, parameters of the house. Free of charge.

Step 2. Response from the administration

7 working days. The administration checks: zoning, setbacks, restrictions, protected zones. Silence = consent.

Step 3. Construction

The notification is valid for 10 years. A design is not legally required but is strongly recommended for quality and budget control.

Step 4. Notification of completion

Within 30 days. Attach a technical plan (15 000–25 000 ₽) and the 350 ₽ state fee. Registration in Rosreestr — 7 working days.

SNT (garden cooperative) plots

• Garden house (seasonal) — via notification

• Residential house — also via notification, but must meet residential standards

• You can register residence only in a residential house

• SNT by-laws may add limits but cannot contradict the law

On “ogorodnichestvo” plots, only outbuildings are allowed — no garden or residential houses.

Protected zones

• Gas pipelines — 2 to 350 m

• Power lines — 2 to 55 m

• Water protection — 50–200 m

• Airfields — height limits

• Cultural heritage — height and appearance limits

• Sanitary protection zones — limits on residential development

Setbacks (SP 53.13330.2019)

• From neighbour — 3 m

• From street red line — 5 m

• From driveway red line — 3 m

• From outbuildings to neighbour — 1 m

Consequences of building without notification

• Fine 2 000–5 000 ₽

• Problems registering ownership

• Risk of demolition by court order

• Cannot connect gas and centralised utilities

• Cannot sell or inherit the house

Dacha amnesty until 2031

A simplified registration for houses built without notification is extended to 1 March 2031. Covers IZHS/LPH/SNT with a technical plan and title documents. Cost 15 000–30 000 ₽. Does not apply to houses violating zoning rules.
